Introduction

In a significant development for the renewable energy sector in Haryana, the Haryana Electricity Regulatory Commission (HERC) recently dismissed petitions filed by the state’s two power distribution companies (DISCOMs), Uttar Haryana Bijli Vitran Nigam (UHBVN) and Dakshin Haryana Bijli Vitran Nigam (DHBVN). These DISCOMs sought approval to increase the surcharge levied on consumers accessing electricity directly from independent power producers, commonly known as open access consumers.

Background:

The DISCOMs argued that a surge in open access transactions, driven by the increasing adoption of solar energy and other renewable energy sources, had led to higher instances of “stranded power” – electricity generated but not consumed due to decreased demand from open access consumers. To recover these increased costs, the DISCOMs proposed a significant increase in the surcharge rate levied on open access consumers.

HERC’s Decision:

However, HERC did not approve the surcharge hike. The Commission found several shortcomings in the DISCOMs’ petitions:

  • Outdated Data: The petitions relied on data from the first half of the financial year (FY) 2023-24, while the relevant data for determining the surcharge should have been from the second half of the same fiscal year.
  • Retroactive Application: The Commission recognized that any surcharge determined could not be applied retroactively. Due to the Model Code of Conduct in effect following the announcement of state legislative assembly elections, no tariff-related orders could be issued during that period.
  • Insufficient Justification: The DISCOMs may not have provided adequate evidence to support the proposed surcharge increase.
